Terms and Conditions

1.  General Information

These Terms and Conditions govern all traders booking a pitch at Porthleven Market. By completing a booking, traders confirm they have read, understood, and agreed to abide by these terms and any additional rules set by Market Management.

Market Areas & Operating Hours

All market areas operate between 10.00am and 5.00pm. The two market areas are:

The Shipyard Market

  • Off-Season (14 Feb – Easter Holidays & 1 Nov – End of Dec): Wednesday to Sunday
  • Summer Season (Easter Holidays – End of October): Tuesday to Sunday
  • 7 days per week during Cornwall School Holidays and Bank Holiday Mondays

The Harbour Market

  • 1 April – End of October: Tuesday, Thursday and Sunday
  • 1 July – 12 September: Open daily
  • Also open on Bank Holidays throughout the season

Market Ethos & Trader Acceptance

Porthleven Harbour Market is committed to maintaining a diverse and high-quality offer, with an emphasis on artisan, honestly priced, and carefully sourced products. We welcome:

  • Primary food producers and growers
  • Artisan food and drink producers
  • Handmade, locally sourced, arts, crafts, homeware and clothing
  • Independent merchants who can demonstrate individuality and ethical sourcing (limited numbers accepted)

To maintain a balanced and varied range of products, Management will assess applications on a per-day basis and reserves the right to accept or decline any application. Where a date is fully subscribed, traders may be placed on a waitlist.

Porthleven Market reserves the right to refuse any application or cancel any booking where, in the opinion of Market Management, it is necessary to do so.

2.  Booking Process

All applications for pitch bookings must be made via the Eventaly booking platform. Management is not able to make applications or pitch bookings on behalf of traders.

Applications must be submitted at least 24 hours before the intended trading date. Applications made after this time cannot be guaranteed a timely response.

Pitches are allocated on a first-come, first-served basis and are not confirmed until full payment has been received.

Pitch Restrictions — Pitch 12 (Shipyard Market)

Jewellery — whether as a primary or secondary part of a trader's offering — is not permitted in Pitch 12 of the Shipyard Market. If jewellery is found to be sold from Pitch 12 and has not been declared on the trader's Eventaly account, subsequent bookings may be cancelled or relocated to an alternative pitch without refund.

3.  Fees and Payment

2026 Pitch Fees

All prices are per trading day. VAT applies to Shipyard Market pitches only. Harbour Market pitches are VAT-exempt.

Electricity is included in the pitch price for the Pergolas and Shipyard Market pitches. Usage will be monitored and additional charges may apply where consumption significantly exceeds average levels.

No electricity is available at Harbour Head pitches. Traders must not use any sockets located around the harbour, as these are not under the management of Porthleven Market.

Payment Terms — Bookings Up To 17 February 2026

Traders whose bookings were allocated on or before 17 February 2026 will have received an invoice including a non-refundable £5 deposit per trading day. The balance is due within 30 days of the trading date.

Payment may be made via Stripe or by BACS bank transfer. For BACS payments, please include the word 'Market' as your payment reference, and send confirmation of payment (including the amount and dates covered) to [email protected].

Payment Terms — Bookings From 17 February 2026 Onwards

For all bookings made from 17 February 2026, invoices will be issued at the beginning of the month prior to the trading date. Payment is due within 7 days of invoice.

No deposit system applies to these bookings. Payment must be made in full via Stripe. BACS payments cannot be accepted for bookings made from this date.

Late Bookings

Any pitch booked within 14 days of the trading date must be paid in full upon receipt of the acceptance invoice.

Non-Payment & Outstanding Balances

Porthleven Market reserves the right to cancel any booking where payment has not been received within 7 days of invoicing. Where a trader's account carries an outstanding balance, Management reserves the right to withhold acceptance of future bookings until the account is cleared.

4.  Cancellations and Market Changes

Cancellations by the Trader

All cancellations must be made via the Eventaly booking system. No refunds will be issued for trader cancellations.

  • Where notice is given at least 21 days before the trading date, Management will endeavour to move the booking to an alternative date, subject to availability.
  • Where another registered trader is able to take the vacated pitch, a credit may be applied to a future trading day.
  • All cancellations and pitch transfers must be completed at least 48 hours before the trading date.
  • Pitch transfers to another trader must be arranged via the Eventaly system with prior notice to Market Management, to allow for verification of the incoming trader's Public Liability Insurance and to ensure the ongoing curation of the market's offering.

Cancellations by Market Management

Porthleven Market reserves the right to cancel, relocate, or reschedule any market day due to unforeseen circumstances, including but not limited to:

  • Extreme weather events (Met Office Amber or Red weather warnings)
  • Public safety concerns or emergency incidents
  • Circumstances beyond the reasonable control of Market Management

In the event of a Market Management cancellation, traders may be offered a credit to carry forward to another trading date. Refunds will not be issued in these circumstances.

No refunds will be given for non-attendance, adverse weather conditions below amber/red warning level, or any other circumstances not falling within the above.

5.  Stall Setup and Equipment

All pitches in all areas are sold as spaces only. Traders must supply their own tables, display equipment, and any other materials required for trading.

  • All display structures must be free-standing. No fixings, drilling, or attachments may be made to any pergola, structure, or market facility.
  • Traders on Harbour Head grassed gazebo pitches must provide a strong, weatherproof gazebo.
  • Traders must not exceed their allocated pitch size.
  • Any additional equipment must be approved by Market Management in advance.
  • Any damage caused to market infrastructure by a trader must be paid for immediately upon notification.

Pitch Cleanliness

Traders are responsible for leaving their pitch in a clean and tidy condition at the end of each trading day.

  • All rubbish, packaging, and debris must be removed and disposed of by the trader at their own business facilities.
  • Traders must not use public litter bins or any bins within the Shipyard Market area for stall waste.

6.  Trading Hours and Attendance

The market operates between 10.00am and 5.00pm. Traders are expected to trade for the full duration of market hours.

  • Traders must arrive at least one hour before opening to set up. Stalls must be fully operational and ready to trade by 10.00am.
  • Trading must continue until 5.00pm. Traders must vacate their pitch within one hour of the market's close.
  • Traders must attend all pre-booked market days. Failure to attend without prior notification may affect future booking acceptance.

Vehicle Access & Unloading — Harbour Market

  • Traders may arrive to unload from 8.00am. All vehicles must keep roads and pavements clear at all times during unloading.
  • All vehicles must be cleared from Breageside and the Harbour Head by 9.30am.
  • No vehicles may be parked by the Beach Huts or the Pergolas during market hours, except for the purposes of loading and unloading.
  • No vehicle may be parked or driven onto the Harbour Head at any time without prior permission from Market Management or the Harbour and Dock Company.

Vehicle Access & Unloading — Shipyard Market

  • A 30-minute unloading permit must be displayed in the vehicle windscreen during loading and unloading. Permits are located in the Shipyard Market storeroom and must be returned after each use.
  • Traders must unload directly in front of the market entrance doors.
  • All vehicles must be clear of the Shipyard area by 9.45am.
  • Vehicles may not re-enter the Shipyard for loading until after the market closes at 5.00pm.

Evening loading ahead of a trading day is no longer permitted in the Shipyard Market, due to private events taking place after market hours.

7.  Insurance and Legal Compliance

  • All traders must hold valid Public Liability Insurance (PLI) with a minimum cover of £5 million. Proof of PLI must be available upon request.
  • Traders selling food or drink must comply with all applicable Food Safety and Hygiene Regulations and must be able to provide relevant documentation, including Food Hygiene ratings and allergen information where required.
  • All electrical appliances used at a trader's stall must hold a current PAT (Portable Appliance Test) certificate.
  • Traders are solely responsible for ensuring that all their activities, products, and practices comply with applicable legislation, including but not limited to trading standards, intellectual property, and consumer protection laws.
  • Traders must ensure that any personal data they collect (e.g. from customers) is handled in accordance with the UK General Data Protection Regulation (UK GDPR).

8.  Health and Safety

  • Traders must maintain a clean, tidy, and safe trading environment at all times.
  • The use of gas appliances must be pre-approved by Market Management and all equipment must meet current safety regulations and be in good working order.
  • Traders must not obstruct walkways, roadways, emergency exits, or neighbouring traders' stalls at any time.
  • Any accidents, incidents, or near-misses occurring at or near a trader's pitch must be reported to Market Management promptly.
  • Market Management reserves the right to require a trader to modify or remove any element of their setup that is deemed to present a safety risk.

9.  Conduct and Market Rules

  • Traders must conduct themselves in a professional and respectful manner towards customers, fellow traders, and market staff at all times.
  • Discrimination, harassment, intimidation, or disruptive behaviour of any kind will not be tolerated and may result in immediate removal from the market without refund.
  • The sale of counterfeit, unlicensed, illegal, or otherwise inappropriate goods is strictly prohibited.
  • Music or amplified sound must be kept at a level that does not cause nuisance to neighbouring traders or the public. Market Management may request that volume be reduced.
  • Shipyard Market pitches may only be shared with a second trader by prior agreement with Market Management at the time of booking. Harbour Market pitches are for the use of the booking trader only.
  • Dogs are welcome to accompany traders but must be kept under control at all times. Market Management reserves the right to require a dog to be kept on a lead if it is causing a nuisance to the public or fellow traders.

Sustainability & Packaging Policy

Porthleven Market operates a strict no single-use plastic packaging policy. Traders are required to use sustainable alternatives for all food, drink, art, and craft packaging, including:

  • Recycled paper bags
  • Cardboard packaging
  • Compostable or biodegradable alternatives

Porthleven sits within a beautiful marine environment and we ask all traders to share our commitment to protecting it. Failure to comply with this policy may affect future booking acceptance.

10.  Evening Events

The Shipyard Market space is available for hire for private evening events. These events are predominantly organised by our resident traders and may take place on evenings following a standard market trading day.

Where a daily trader has bookings on consecutive days, they may leave their stall set up overnight. However, traders must ensure that all stock is adequately secured at the end of the trading day. Porthleven Harbour and Dock Company accepts no responsibility for any loss of, or damage to, trader stock or equipment during evening events.

Traders will be notified in advance by Market Management if an evening event is scheduled to take place on a date falling within their consecutive booking period.

11.  Data Protection and Privacy

Porthleven Market collects and stores trader information for the purposes of market administration, communication, and compliance. All data is held securely and in accordance with the UK General Data Protection Regulation (UK GDPR).

  • Trader personal data will not be shared with third parties without consent, except where required by law.
  • Traders have the right to request access to, correction of, or deletion of their personal data by contacting [email protected].

12.  Agreement

By submitting a booking application to Porthleven Market, traders confirm that they have read, understood, and agreed to abide by these Terms and Conditions in full, and any additional guidance issued by Market Management.

Any instruction given by the Market Manager carries full authority and is to be regarded as final.

These Terms and Conditions are reviewed annually. Porthleven Market reserves the right to amend these terms at any time. Traders will be notified of any significant changes via the Eventaly platform or by email.
