MID CENTURY FLEA TRADER TERMS & CONDITIONS
1. The Organiser and Acceptance of These Terms
Mid Century Flea is organised by Fluent Marketing & PR ("the Organiser", "we", "us" or "our"). These
Terms & Conditions apply to every trader, exhibitor, business or individual ("Trader") who applies for or
books trading space at a Mid Century Flea event ("Event").
By submitting an application, accepting a space, paying any part of a pitch fee or attending an Event,
the Trader confirms that they have read, understood and agree to these Terms & Conditions.
2. Trader Applications and Acceptance
Mid Century Flea is a curated market. Submission of an application does not guarantee a trading
space. We may accept or decline applications in order to maintain the quality, character and
appropriate mix of Traders and products at each Event.
Acceptance at one Event does not guarantee acceptance or availability at future Events. A trading
space may not be transferred, shared, sub-let or resold without our prior written agreement.
3. Stock and Curation
Mid Century Flea focuses primarily on original mid-century, vintage and appropriately complementary
furniture, lighting, ceramics, glassware, artwork, homeware, textiles, fashion, collectables and design.
Traders should accurately describe the type of stock they intend to bring. We understand that vintage
stock changes regularly and do not require an exact inventory, but the general character and quality
of the stock offered should be consistent with the Trader's application and the nature of the Event.
We may ask for items to be removed where we reasonably consider them inappropriate for the Event,
unsafe, illegal, counterfeit, offensive or materially different from the type of stock for which the Trader
was accepted. Newly manufactured products should only be offered where agreed with us or where
they are considered complementary to the Event.
4. Stall Allocation
Trading spaces are allocated by the Organiser. We will make reasonable efforts to accommodate
requests regarding position, size or neighbouring Traders, but a particular location cannot be
guaranteed.
Floor plans may change before or during an Event for operational, safety, venue or access reasons. We
may relocate or adjust a trading space where reasonably necessary. Stock, displays and equipment
must remain within the allocated area unless permission is given otherwise. Gangways, entrances,
emergency exits and access routes must remain clear.
5. Booking and Payment
The price of a trading space will be confirmed before or at the time of booking. A booking is confirmed
only once the required payment has been received and confirmation has been issued by us.
Unless otherwise agreed, pitch fees must be paid by the deadline stated in the booking information or
invoice. If payment is not received by that deadline, we may release the space to another Trader.
Additional services requested by the Trader may incur additional charges.
6. Trader Cancellations
If a Trader is unable to attend, they should notify us as soon as possible. Unless different cancellation
arrangements were clearly stated at the time of booking: more than 28 days before the Event, the
pitch fee will be refunded less any clearly identified non-refundable booking or administration fee;
14-28 days before the Event, we may refund 50% of the pitch fee; less than 14 days before the Event,
pitch fees will normally be non-refundable.
If we are able to reallocate the space, we may at our discretion offer a refund or credit towards a
future Event. Failure to attend without notifying us will not normally qualify for a refund or credit.
7. Event Cancellation, Postponement or Material Change
If we cancel an Event and no replacement date is offered, Traders will normally receive a refund of the
pitch fee paid for that Event. If an Event is postponed, Traders will normally be offered the opportunity
to transfer their booking to the replacement date.
Where circumstances outside our reasonable control prevent an Event from proceeding as planned, we
will act reasonably in deciding whether fees can be refunded, transferred or credited, taking account of
costs already irrecoverably incurred. Such circumstances may include severe weather, flooding, fire,
failure of utilities, venue closure, transport disruption, civil emergency, government restrictions or
other events outside our reasonable control.
Except where liability cannot lawfully be excluded, we are not responsible for consequential costs
incurred by a Trader because an Event is cancelled, postponed, relocated or changed, including travel,
accommodation, staffing or stock-transport costs.
8. Setup, Trading and Breakdown
Traders must comply with the arrival, unloading, setup, public opening and breakdown times supplied
for each Event. Traders should arrive with enough time to unload and prepare before the Event opens.
Vehicles must be removed from loading areas when requested. Trading spaces should be fully
presented when the Event opens. Traders must not substantially dismantle or pack away before the
advertised closing time without our permission. At the end of the Event, all stock, equipment,
packaging and rubbish must be removed and the space left reasonably clean.
9. Health and Safety
Every Trader is responsible for operating their trading space safely. Displays, furniture, shelving, rails,
lighting and other equipment must be stable, secure and suitable for use in a public environment.
Items must not create trip hazards or obstruct gangways, doors, fire exits, fire-fighting equipment or
other Traders. Traders must comply with reasonable health and safety instructions issued by us, the
venue or authorised personnel. We may request a risk assessment or other relevant safety
documentation.
If we reasonably believe a stand, item or activity presents a significant safety risk, we may require it to
be altered or removed before trading can continue.
10. Insurance
Each Trader must hold appropriate insurance for their business and activities. As a condition of trading
at Mid Century Flea, every Trader must hold Public Liability Insurance with a minimum indemnity limit
of £1,000,000 for the Event.
Evidence of valid cover must be supplied if requested by Fluent Marketing & PR or the venue. Where a
Trader employs staff, the Trader is responsible for maintaining Employers' Liability Insurance where
required by law. Traders are also responsible for deciding what additional insurance they require for
stock, equipment, vehicles and other business risks.
11. Product Safety and Legal Compliance
Traders are responsible for ensuring that everything they offer for sale complies with applicable UK law
and safety requirements, including relevant product safety, labelling, consumer protection and
restricted-product rules. Particular care should be taken with vintage goods where legal requirements
may still apply.
12. Upholstered Furniture
Traders selling upholstered furniture are responsible for ensuring that the items they sell comply with
applicable fire and furniture safety legislation. Where labelling or evidence of compliance is legally
required, the Trader is responsible for ensuring it is present and appropriate. We may require an item
to be removed from sale where there are reasonable concerns about safety or legal compliance.
13. Electrical Items and Lighting
Traders selling electrical items, including vintage lighting, are responsible for ensuring that products
are safe and legally suitable for sale. Electrical equipment used on a stand must also be safe and
suitable for use in a public venue.
The venue or Organiser may require electrical equipment used at the Event to meet specified
inspection or testing requirements. Extension leads must be suitable for their intended use and
positioned so that they do not create trip or electrical hazards.
14. Prohibited and Restricted Goods
Traders must not offer for sale goods that are illegal, stolen, counterfeit or unsafe. Weapons,
hazardous substances, illegal substances or other restricted products must not be brought to or sold at
an Event unless their presence has been expressly authorised by us and is lawful. We may require any
item reasonably considered inappropriate, unsafe or unlawful to be removed.
15. Food, Drink and Alcohol
Food and drink may only be sold where this has been agreed as part of the Trader's booking. Food
Traders are responsible for complying with all applicable food hygiene, registration, allergen, labelling
and safety requirements. Alcohol may not be sold or supplied unless expressly agreed with us and all
necessary licensing requirements have been satisfied.
16. Fire Safety
Naked flames, candles, portable heaters, gas appliances or similar equipment must not be used
without prior permission. Traders must comply with venue fire-safety procedures and instructions from
Event staff. Emergency exits, fire extinguishers and fire routes must remain unobstructed.
17. Damage to the Venue
Traders must take reasonable care not to damage the venue, floors, walls, fixtures or equipment.
Nothing should be drilled, screwed, nailed, glued or permanently fixed to the venue without
permission. A Trader may be responsible for the reasonable cost of repairing damage caused by them,
their staff or their equipment.
18. Trader Conduct
Mid Century Flea aims to provide a welcoming, enjoyable and professional environment for Traders,
visitors and venue staff. Abusive, threatening, discriminatory, intimidating or seriously disruptive
behaviour will not be tolerated.
Traders are responsible for the conduct of anyone working with them. We may require a Trader or
member of their team to leave where behaviour presents a safety issue or constitutes a serious breach
of these Terms.
19. Staffing and Supervision
Traders are responsible for adequately staffing and supervising their trading space throughout the
Event. We cannot supervise individual stands or stock on behalf of Traders. Anyone assisting a Trader
is expected to comply with these Terms and venue rules.
20. Children and Animals
Where children accompany Traders during setup, trading or breakdown, they remain the responsibility
of the accompanying adult and must be appropriately supervised. Animals may only be brought into
the venue where permitted by the venue and must remain under appropriate control. Assistance dogs
are permitted in accordance with applicable law.
21. Security, Stock and Personal Property
Traders remain responsible for their stock, cash, payment devices, equipment, vehicles and personal
possessions. Although we and the venue may take reasonable measures appropriate to the Event, we
cannot guarantee the security of individual Traders' property.
Traders should ensure valuable items and cash are appropriately supervised and insured. Except to
the extent that liability cannot lawfully be excluded or limited, we are not responsible for loss, theft or
damage to a Trader's stock or property.
22. Sales and Customers
All sales are transactions between the Trader and the customer. The Trader is responsible for pricing,
receipts, payment processing, refunds, returns, guarantees and customer service, and for complying
with applicable consumer-protection law. Disputes relating to goods purchased from a Trader should
normally be resolved between the Trader and the customer.
23. Loading, Vehicles and Parking
Event-specific loading, unloading and parking arrangements will be communicated before each Event.
Traders must follow instructions from us, venue staff and parking or security personnel. Vehicles must
not remain in loading areas longer than reasonably necessary and must be moved when requested.
Parking is subject to the rules and charges of the relevant car park or operator. Unless specifically
stated otherwise, a trading-space booking does not include parking.
24. Photography, Video and Event Promotion
Photography and filming may take place during Mid Century Flea events for promotional, editorial and
social-media purposes. This may include general views of the Event, individual stands and products on
display.
Traders should tell us in advance if there is a particular commercial or practical concern regarding
photography of their stand. Where identifiable individuals are the primary subject of photography or
filming, we will seek to handle such material appropriately and in accordance with applicable privacy
and data-protection requirements.
25. Trader Marketing Material
By providing us with a business name, logo, photographs, social-media details or other promotional
material, the Trader grants Fluent Marketing & PR permission to use that material for the reasonable
purpose of promoting the Trader's participation and Mid Century Flea.
The Trader confirms that they have the necessary rights to provide the material for this purpose. This
permission does not transfer ownership of the Trader's intellectual property to us.
26. Data Protection
We will use information supplied by Traders for purposes connected with administering bookings,
operating Events, communicating important Event information and managing our relationship with
Traders. Personal information will be handled in accordance with applicable UK data-protection law
and our Privacy Policy where applicable. We will not sell Trader contact information to third parties.
27. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability
for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to this, Fluent Marketing & PR will not be responsible for indirect or consequential losses
arising from a Trader's participation in an Event. Traders are responsible for losses, claims or damage
resulting from their own negligence, breach of these Terms or unlawful activities, subject to applicable
law.
28. Compliance with Venue Rules
In addition to these Terms, Traders must comply with reasonable rules and instructions imposed by
the Event venue. Where venue requirements relate to safety, licensing, fire precautions, access or
legal obligations, they will take precedence over conflicting operational arrangements.
29. Organiser's Authority
Fluent Marketing & PR may give reasonable instructions necessary for the safe and effective operation
of an Event. Where a Trader seriously breaches these Terms, refuses to comply with reasonable safety
instructions or behaves in a way that materially affects the Event, we may require them to stop trading
or leave the venue.
In serious cases, the Trader may also be refused bookings at future Mid Century Flea events. No refund
will normally be payable where a Trader is required to leave because of their own serious breach of
these Terms.
30. Changes to Event Arrangements
We may make reasonable changes to Event layouts, access arrangements, opening procedures,
facilities, Trader positions or other operational details where necessary. We will endeavour to
communicate significant changes to affected Traders as soon as reasonably practical.
31. Complaints and Disputes
If a Trader has a concern or complaint, we encourage them to raise it with the Event organiser as soon
as possible so that we have an opportunity to address it. Complaints following an Event should be
submitted in writing within a reasonable period. We will endeavour to resolve disputes fairly and
informally wherever possible.
32. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will
continue to apply.
33. Governing Law
These Terms and any dispute arising from them are governed by the laws of England and Wales. The
courts of England and Wales will have jurisdiction, subject to any rights that cannot lawfully be
excluded.
34. Acceptance
By submitting an application, confirming a booking, paying for a trading space or attending a Mid
Century Flea Event, the Trader confirms that they have read, understood and agreed to these Terms &
Conditions. Traders are responsible for ensuring that anyone attending the Event on their behalf is
aware of and complies with the relevant requirements.
